With over 20 years of experience in state and federal courts, Chris Duerr has successfully litigated many complex eminent domain, commercial and professional liability cases.  As Counsel to PennDOT, Chris handled eminent domain matters which often included complex zoning, land use, environmental, development, business valuation, easements, and construction issues as well as employment cases.  While at PennDOT, he also acted in a prosecutorial role, prosecuting thousands of license suspension cases, including DUI-related, Commercial Driver License, Dealer and Agent and State Inspection Station matters. Chris also served as a Commissioner on the Planning Commission in his home community for approximately ten years, regularly reviewing subdivision and land development submissions.

Eminent Domain

When a landowner receives a settlement offer in connection with land condemnation, the landowner should never accept the offered settlement amount without consulting with an experienced eminent domain attorney and having their own appraisal completed.  It is important to understand that the condemning party must pay the fair market value of any property it takes through eminent domain.  In most situations the condemning party will try to spend as little as possible to obtain the property by valuing the property at less than its fair market value.  Fortunately, the Eminent Domain Code allows for the property owner to receive reimbursement for the services of an attorney, appraiser and/or engineer up to the amount of $4,000.
